This site, Makeyouhip.com, (hereafter referred to as Makeyouhip.com, Hip Web Design, site, or Website) is owned and operated by Robert Rex (hereinafter referred to as Robert, Rob, Rob Rex, I, or me ). Please carefully read, review and be sure you understand my Terms of Use prior to downloading or using any of the materials or Products from Makeyouhip.com. You should carefully read all of my terms and conditions as your purchase or use of any Makeyouhip.com Product(s), membership, or services and use of this Website and any materials or Products available herein identifies that you agree to the following Terms of Use and that you agree to be bound by these terms and conditions accordingly. If you do not agree to these terms then you should leave this Website immediately, not use any of the materials or Products available herein, and/or not subscribe to this service

1. LIMITATION OF LIABILITY

UNDER NO CIRCUMSTANCES SHALL Robert Rex BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF DATA OR PROFIT, ARISING OUT OF THE USE, OR THE INABILITY TO USE, THE MATERIALS ON THIS SITE, EVEN IF Robert Rex OR AN AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF YOUR USE OF MATERIALS FROM THIS SITE RESULTS IN THE NEED FOR SERVICING, REPAIR OR CORRECTION OF EQUIPMENT OR DATA, YOU ASSUME ANY COSTS THEREOF.

2. License

My themes are created for WordPress, an open source software released under the GNU public license http://www.gnu.org/licenses/gpl.html . Therefore any part of my themes which constitute a derivative work of WordPress are also licensed under the GPL 3.0. My themes are comprised of several different file types, including: php, cascading style sheets, javascript, as well as several image types including GIF, JPEG, and PNG. All PHP and JS files are released under the GPL 3.0 unless specified as otherwise within the file itself. If specified as otherwise the files are licensed or dual licensed (as stated in the file) under the MIT http://www.opensource.org/licenses/mit-license.php, a compatible GPL license.

All other files, including: cascading style sheets (.css), Photoshop (.psd) files and images(.gif, .jpg, .png), are not compiled together but are sent independently of GPL code and combined in a client’s browser, and do not have to be GPL themselves. These files are not released under the GPL, but instead are given to all members on a personal use basis. When supplied, these files are for personal use only. You may not offer them, modified or unmodified, for redistribution or resale of any kind.

3. Ownership and Liability

You may not claim intellectual or exclusive ownership to any of my products, modified or unmodified. All products are property of Robert Rex. My products are provided “as is” without warranty of any kind, either expressed or implied. In no event shall my juridical person be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use my products.

4. Refund Policy

I do not issue refunds after the purchase is made, which you are responsible for understanding upon purchasing at my site.

5. Warranty

My products are provided “as is” without warranty of any kind, either expressed or implied. I do not guarantee that themes will work in all browsers, nor do I guarantee that my themes will be functional with all versions of WordPress. I do not guarantee compatibility with any additional third party plugins, scripts, or applications.

6. Modifications

You are authorized to make any necessary modification(s) to my products to fit your specific needs, however, you may not redistribute or re-release my themes as a whole, even after modifications have been made. Only PHP and Javascript files are released under the GPL, and may be redisributed under the terms of the GPL. You may remove my credit links under the understanding that all themes downloaded are still copyright of Robert Rex, and that all plugins utilized must retain their respective licenses.

7. Payments

All payments are handled through PayPal. Payments are non-recurrent.
